Terms of Service

These Terms of Service govern your access to and use of English via Mia, a digital English-learning product available at https://englishviamia.com/.
English via Mia is operated by TravelAsk Limited, reg. no. 76185799, Unit B, 11/F, Wah Kit Commercial Building, 302 Des Voeux Road Central, Sheung Wan, Hong Kong.
By using English via Mia, creating an account, starting a trial, or purchasing a subscription, you agree to these Terms.
1. The service
English via Mia provides digital English-learning materials, including vocabulary cards, translations, examples, practice flows, and related learning features.
The product is designed for personal learning and practice. We may update, improve, remove, or replace content and features as the product develops.
Unless stated otherwise at checkout, "full access" means access to the paid English via Mia learning content and features that are available for your active plan or trial during the relevant access period. It does not mean lifetime access, access to every future feature, or access to services outside English via Mia.
2. Eligibility
English via Mia is not intended for children under 16.
If you are under 18, you should use the service only with the involvement and consent of a parent or legal guardian.
You must provide accurate information when creating an account or purchasing access.
3. Accounts and access
You are responsible for keeping your account credentials secure and for all activity under your account.
After successful payment, access may be provided through the website, an account, an email link, or another access method shown at checkout or in our communications.
Access is for your personal use only. You may not share, resell, sublicense, copy, scrape, or redistribute the service or its content.
4. Plans, pricing, trials, and billing
English via Mia may offer monthly, multi-month, annual, trial, promotional, or other subscription plans.
The current plan details, billing period, trial terms, renewal terms, price, first charge date, and whether the subscription renews automatically are shown on the website, pricing page, or checkout page before purchase. If there is any difference between a price or billing term shown in these Terms and the checkout page, the checkout page controls for that purchase.
Taxes, currency conversion, bank fees, or payment-provider fees may apply depending on your location and payment method.
Payments are processed by Stripe or another payment provider. We do not store your full payment-card details.
Unless stated otherwise at checkout, subscriptions renew automatically at the end of each billing period or trial period until cancelled.
If a free trial is offered, the checkout page will show the trial length and when the first paid charge is scheduled. If the checkout page says there is no charge today, your card should not be charged for the subscription until the first paid charge date shown at checkout. If you cancel before the free trial ends, you should not be charged for that subscription. If you do not cancel before the trial ends, the subscription may convert into a paid recurring subscription under the plan terms shown at checkout.
5. Cancellation
You can cancel your subscription at any time through the subscription management link provided after purchase or by contacting us at support@englishviamia.com.
Cancellation stops future renewals. It does not automatically refund the current billing period unless our Refund and Cancellation Policy applies.
If you ask support to cancel for you, contact us before the next renewal or trial-end charge and allow reasonable time for processing. We will take reasonable steps to help, but you remain responsible for cancelling through the subscription management link where that option is available.
6. Refunds
Refunds are handled under our Refund and Cancellation Policy.
In short, you may request a refund within 7 days after your first purchase. We may also issue refunds for duplicate charges, technical errors, or failure to provide access caused by us.
If we accept payment but cannot provide access to the digital product within a reasonable time because of an issue caused by us, you may be eligible for a refund under the Refund and Cancellation Policy.
7. Acceptable use
You agree not to:
- use the service for illegal, harmful, fraudulent, or abusive purposes;
- interfere with the operation or security of the service;
- attempt to reverse engineer, scrape, copy, or mass-download the service or its content;
- share paid access with other people;
- use automated tools to access the service without permission;
- infringe intellectual property, privacy, or other rights.
We may suspend or terminate access if we reasonably believe these Terms have been violated.
8. Intellectual property
The service, content, design, learning materials, text, cards, software, branding, and related materials belong to TravelAsk Limited or its licensors.
You receive a limited, personal, non-transferable, non-exclusive right to use the service for your own learning while your access is active.
No ownership rights are transferred to you.
9. Educational content
English via Mia is an educational tool. We try to make learning content accurate and useful, but we do not guarantee that every translation, example, pronunciation, tag, or explanation will be perfect or suitable for every context.
You are responsible for how you use the learning materials.
10. Third-party services
The service may use third-party providers, including payment processors, authentication providers, analytics tools, email tools, hosting providers, and advertising platforms.
Your use of those third-party services may also be subject to their own terms and policies.
11. Privacy
Our collection and use of personal data is described in our Privacy Policy and Personal Information Collection Statement.
12. Service availability
We aim to keep the service available, but we do not guarantee uninterrupted or error-free access. The service may be unavailable due to maintenance, updates, provider outages, security issues, or other reasons.
13. Disclaimers
The service is provided on an "as is" and "as available" basis.
To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.
14. Limitation of liability
To the maximum extent permitted by law, TravelAsk Limited will not be liable for indirect, incidental, special, consequential, punitive, or lost-profit damages.
Our total liability for any claim related to the service is limited to the amount you paid to us for the service during the 3 months before the event giving rise to the claim.
Nothing in these Terms limits liability that cannot be limited under applicable law.
15. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify users, such as by updating the date above or posting a notice on the website.
Your continued use of the service after changes take effect means you accept the updated Terms.
16. Governing law
These Terms are governed by the laws of Hong Kong, unless mandatory consumer protection laws in your country require otherwise.
